Medical Devices

Nationally, there has been an alarming rise in the failure of a particular medical device known as EpiPens. These medical instruments are used during emergencies to inject epinephrine, a hormone and neurotransmitter, into a person experiencing a life-threatening allergic reaction, or anaphylaxis. Millions of Americans are prescribed EpiPens every year to treat anaphylaxis caused by food allergies, bee allergies, and medication allergies.

If an EpiPen fails to work, a person suffering from an allergic reaction can become severely ill or die.

A recent investigation from the US Food and Drug Administration found that Mylan, an EpiPen and EpiPen components manufacturer, did not properly test the devices before selling them and did not adequately address numerous complaints of EpiPen failure or malfunction. An FDA inspection was conducted on the Pfizer manufacturing facility in March 2017. The investigation found that the facility was in violation of good manufacturing practices. A letter issued by the FDA to the manufacturer on September 5, 2017 detailed the company’s failure to thoroughly investigate unexplained failures in batches of EpiPens, despite having identified that some units in those batches had a failing component that caused the auto-injector to fire improperly. The FDA also found that the Pfizer facility’s procedure for handling complaints was inadequate. These violations were also found in a previous inspection of the facility in October and November, 2014.
